Two journalists from a news organization serving Hong Kong’s Filipino community are being sued for defamation over their coverage of an assault by lawyer Jacob Shek Yuehei.
Last year, The Sun reported on a case in which Filipino domestic worker Romaline Marinay was accused of common assault against her male employer, Sheku. Mr Mullinay was represented by his senior adviser Mr Selwyn Yu.
Marinay was acquitted of all charges last month. Eastern Court Judge Minnie Watt also allowed the defense to recover costs from the prosecution.
Sun newspaper defamation claim
On February 7, journalists Daisy CL Mandap and Leo A. Deocadis filed subpoenas claiming that two online news articles published by The Sun in connection with the trial defamed Sheku. received. The request, obtained by HKFP, also seeks recovery of costs and an injunction against further distribution of the article.
Robertson Law Firm, which represents Sheku, told Hong Kong FP last Friday that it respects freedom of speech and freedom of the press. “However, such freedom is not absolute and is subject to defamation laws, especially if the content of the publication is false, inaccurate or misleading,” the company said. The statement added that it could not comment further on ongoing cases.
The Sun’s journalists partnered with prominent human rights law firm Daly & Associates.
Once the warrant is served, news outlets are not allowed to repeat the allegedly defamatory content until the matter is considered in court.
Under local law, anyone who maliciously and intentionally publishes defamatory material is subject to fines and up to two years in prison.
